Maintenance of Law

According to Pakistani family law, it is the husband’s or the father’s responsibility to provide for his wife and child in the best way possible. A husband has a duty of maintenance under Muslim law to care for his wife as long as they are still legally married. It is a husband’s undeniable maintenance law duty to support his wife, and maintenance is neither a gift nor a benefit. Due to a precept in the Holy Quran, a husband is required to provide for his wife from that point forward, whether she is a Muslim or an unbeliever, by providing her with food, clothing, and housing. In accordance with his concept, maintenance law is regarded as an obligation owed by the husband.

Men are in charge of women by [right of] what Allah has given one over the other and what they spend [for maintenance] from their wealth. So righteous women are devoutly obedient, guarding in [the husband’s] absence what Allah would have them guard (4:34).

According to Islamic and Pakistani law, a father or husband is required to provide support for his child or wife, respectively. In the case of a boy, this obligation lasts until the child reaches the age of majority; in the case of a daughter, it lasts until marriage; and he is also obligated to support his wife up until their divorce. Muslim Personal law and rulings from the higher courts dominate Pakistani maintenance law. In Pakistan, the subject of child and wife maintenance is currently covered under the Family Courts Act of 1964 and the Muslim Family Laws Ordinance of 1961 (MFLO).
