A Khula case in Pakistan typically takes between 3 to 6 months from the date of filing to the final decree. The timeline depends on the Family Court’s schedule, whether the husband contests the matter, and how quickly documents are submitted. Courts in Lahore generally process Khula cases within this window when properly filed. If the husband is cooperative and doesn’t contest, the process can sometimes be completed in as few as 2–3 months. Yes. Under Pakistani family law, a wife can obtain Khula even without the husband’s consent through the Family Court. The court can grant Khula if the wife establishes that the marriage has irretrievably broken down. However, without the husband’s consent, the wife may be required to return her mehr (dower). Courts in Pakistan have become progressively more sympathetic to Khula petitions, and our firm has successfully obtained Khula decrees in cases where the husband was uncooperative, residing abroad, or simply refusing to respond.
Under Pakistani family law, the mother generally has priority custody (Hizanat) of children during their early years — specifically, boys until age 7 and girls until puberty, after which the father may apply. After these ages, the court determines custody based on the best interests of the child, considering factors including the child’s own wishes (if old enough), the living environment, and each parent’s ability to provide for the child’s welfare. Custody decisions in Pakistan are never automatic — they are determined by the courts on a case-by-case basis, and we have successfully represented both mothers and fathers in contested custody matters.
Online Nikah is legally valid in Pakistan under certain conditions. The process typically involves the couple giving consent via video call in the presence of witnesses and a Nikah Registrar. The Nikah Nama (marriage certificate) is prepared and signed by authorised representatives. For overseas Pakistanis, this process requires careful preparation to ensure the marriage is legally enforceable in both Pakistan and the country of residence. Inheritance in Pakistan is governed by Islamic law (for Muslims) which sets specific shares for different heirs. A son typically receives twice the share of a daughter. A spouse receives a fixed share depending on whether there are children. Parents and siblings have prescribed shares depending on the composition of the surviving family. The estate must first settle any outstanding debts and bequests before distribution. Inheritance disputes often arise from contested property mutation, disputes among heirs, or overseas heirs being excluded from distribution.
